Proposed section 1
Limited scope
This addendum applies only when FOODERCE has reviewed a current jurisdiction-specific cottage-food basis for the seller, product, preparation location, destination, and fulfillment method. A profile or disclosure does not create an exemption.
Proposed section 2
Registration and training
The seller must maintain every required local registration, food-handler credential, product approval, laboratory result, water test, zoning permission, and renewal, and must provide current evidence when requested.
Proposed section 3
Permitted products
Only products permitted under the applicable cottage-food rule may be listed. The seller must not list prohibited time/temperature-control foods, wholesale products, or products outside an approved process merely by adding a disclaimer.
Proposed section 4
Kitchen and preparation
Food must be prepared only at the declared lawful home or farm kitchen and under required sanitation, household, pet, water, storage, and cross-contact controls. Moving or adding a preparation site requires review before sale.
Proposed section 5
Labels and disclosures
Each package and online listing must contain required product name, producer identity, location disclosure where required, ingredients by weight, major allergens, net quantity, date or lot information, and mandated home-kitchen or non-inspection statement.
Proposed section 6
Direct sale and delivery
The seller must comply with in-state, direct-to-consumer, employee/family delivery, shipping, pickup, farmers-market, event, and resale restrictions. FOODERCE delivery must remain disabled wherever third-party delivery is not affirmatively approved.
Proposed section 7
Complaints and recall
The seller must maintain lot and sales traceability, stop sale immediately when directed, cooperate with public-health authorities, and follow FOODERCE's recall procedure.
