Sets the proposed rules for using FOODERCE while keeping seller, driver, payment, and jurisdiction-specific obligations in separate agreements.
This source draft is not a published database agreement. It cannot be accepted, relied upon, or used to activate an account or transaction.
Proposed section 1
Marketplace role
FOODERCE is intended to connect customers with independent sellers and, where enabled, independent delivery participants. The final terms must state who is the seller of record, when FOODERCE is an agent or service provider, and which party is responsible for food, fulfillment, taxes, refunds, and support.
Proposed section 2
Eligibility and accounts
Users must provide accurate information, protect account access, and satisfy age and authority requirements. Business users must have authority to bind the identified person or entity.
Proposed section 3
Listings and transactions
Listings, badges, source records, reviews, and availability are informational until the server confirms an authorized transaction. FOODERCE review is not government licensing, food-safety certification, or a guarantee.
Proposed section 4
Prohibited conduct
The production terms must prohibit unlawful products, misleading claims, unsafe food, credential evasion, harassment, discrimination, fraud, off-platform circumvention where lawful, account sharing, scraping, security abuse, and interference with investigations or recalls.
Proposed section 5
Payments, cancellations, and disputes
Enabled payment methods, authorization, fees, tips, refunds, chargebacks, cash handling, and benefit-card restrictions must follow the published payment and refund schedules. No draft language activates a payment rail.
Proposed section 6
Suspension and termination
FOODERCE may need to pause listings, orders, payouts, delivery, or accounts for safety, legal, fraud, payment, or eligibility reasons. The final terms must define notice, emergency action, evidence preservation, appeal, and post-termination obligations.
Proposed section 7
Disclaimers and liability
Counsel must draft enforceable warranty, liability, indemnity, dispute-resolution, governing-law, accessibility, force-majeure, and severability provisions appropriate to FOODERCE's actual operating model.
