Proposed section 1
Eligibility and onboarding
The participant must provide accurate identity, license, vehicle, service-area, contact, and consent information and complete every approved screening and training step. Activation requires a human-reviewed current eligibility decision.
Proposed section 2
Independent relationship
No worker-classification conclusion is made in this draft. Counsel must align the agreement and actual operating controls with applicable employment, contractor, tax, wage, scheduling, expense, and benefits law.
Proposed section 3
Vehicle, insurance, and safety
The final policy must specify vehicle condition, coverage, incident reporting, distraction, impairment, passengers, weapons, weather, accessibility, and safe-driving requirements. FOODERCE has not approved a statement that personal insurance alone is sufficient.
Proposed section 4
Food custody and privacy
Drivers must maintain packaging integrity and required temperature controls, follow ordered pickup and proof steps, avoid opening food, protect addresses and access instructions, and use customer data only for the assigned delivery.
Proposed section 5
Offers, compensation, tips, and cash
Before acceptance, the final product must disclose route, stops, estimated time and distance, base pay, incentives, tip treatment, expenses, cash responsibility, and cancellation rules as legally required. Cash and real-money delivery remain disabled.
Proposed section 6
Incidents, reassignment, and evidence
Drivers must promptly report crashes, injuries, food-safety issues, customer safety concerns, missing items, delays, law-enforcement contact, and inability to finish. Proof must be proportionate, private, authentic, and retained only as approved.
Proposed section 7
Suspension and appeal
The final agreement must distinguish emergency safety holds from ordinary performance review and include notice, correction, appeal, adverse-action, data-retention, and deactivation procedures.
