Proposed section 1
Source and authority
The producer must identify whether each item is grown, raised, harvested, processed, packed, or resold by the producer and hold all commodity, dealer, processor, egg, dairy, meat, poultry, scale, nursery, pesticide, and organic authorities that apply.
Proposed section 2
Processing and inspection
Products requiring slaughter, processing, pasteurization, grading, inspection, or licensed packing must use an authorized facility and carry required marks and records. A farm origin does not waive processing rules.
Proposed section 3
Claims
Organic, grass-fed, pasture-raised, regenerative, local, humane, antibiotic, raw, natural, health, and origin claims must be truthful, supportable, and legally permitted. FOODERCE may require substantiation or remove claims.
Proposed section 4
Handling and cold chain
The producer must specify storage, temperature, shelf-life, packaging, pickup, and transportation requirements and provide food that remains safe through the selected handoff.
Proposed section 5
Weights, units, and substitutions
Variable-weight products need an approved estimate, final-price, authorization, and refund method. Sellers may not silently replace species, cut, grade, origin, size, or production method.
Proposed section 6
Traceability and recall
The producer must maintain lot, harvest, processing, supplier, and customer-distribution information required for prompt withdrawal and regulatory cooperation.
